According to a report from AllHipHop, Black Mafia Family leader Demetrius “Big Meech” Flenory has been denied an early release for the third time yesterday when the United States Court of Appeals for the 6th Circuit turned down Meech’s appeal for compassionate release.
Meech and his brother Terry “Southwest T” Flenory filed for early release at the beginning of the pandemic because of the greater possibility of catching the virus in prison. In may, Southwest T was granted an early release due to health conditions, but Meech’s request was denied. Southwest T had his sentence reduced to home confinement, which the circuit court asserted was not a compassionate release.
The court argued that Meech was in better health than his brothr terry, who suffers from blindness an wears prescription compression socks.
Of course, as the leader of BMF, the court says that Meech’s release is too much of a risk to the safety of the public.
“None of the facts about Flenory’s brother (or his similarity to Flenory) changes any of the factors the court relied on: namely, protecting the public from further crimes, upholding the seriousness of the offense, promoting respect for the law, and deterring criminal conduct,” the judge wrote in a statement. “A court does not abuse its discretion by refusing to place sentencing disparity alone above the other factors. The district court did not misapply the law or rely on clearly erroneous facts in finding that Flenory did not show extraordinary or compelling circumstances.”
Meech’s release date is set for 2031.
